These Terms of Service ("Terms") govern your access to and use of our web‑hosting services, websites, dashboards, software, and related offerings (collectively, the "Services"). By creating an account, purchasing a plan, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility & Account Security

• You must be at least 18 years old and able to form a binding contract to use the Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to keep your contact and billing information accurate and up‑to‑date.

2. Service Plans & Billing

• Free Orbit – no charge, limited to one (1) website and 5 GB storage.
• Lifetime Hyperdrive – one‑time fee of USD $125 for up to ten (10) websites and 100 GB storage.
• All fees are non‑refundable except as explicitly stated in our 30‑day money‑back guarantee for Lifetime purchases.
• We reserve the right to refuse or cancel orders and to correct pricing errors at any time.

3. Acceptable Use Policy (AUP)

You agree not to use the Services to:

• Violate any applicable law, regulation, or third‑party right.
• Transmit or store content that is illegal, harmful, copyrighted without permission, hateful, or obscene.
• Engage in spam, phishing, malware distribution, DDoS attacks, or cryptocurrency mining without explicit written consent.
• Consume excessive CPU, RAM, or bandwidth in a manner that disrupts other users. We may throttle or suspend accounts that exceed fair‑use thresholds.

4. Uptime & Performance

• We target 99.99 % monthly uptime for paid plans. Scheduled maintenance (with 24‑hour notice) and circumstances beyond our reasonable control (force majeure) are excluded.
• Our liability for downtime is limited to service credits equal to one (1) additional month of Free Orbit service or, for Lifetime Hyperdrive customers, an additional 30 days of backup retention.

5. Backups & Data Integrity

• We perform automated daily off‑site backups with 30‑day retention on paid plans. Free plans include daily backups with 7‑day retention.
• While we take reasonable measures to safeguard data, you are solely responsible for maintaining independent backups of your content.

6. Domain Names & SSL Certificates

• Domain registration and renewal are provided by third‑party registrars and are subject to their terms.
• Free Let’s Encrypt SSL certificates are issued and auto‑renewed on a best‑effort basis. We are not liable for certificate issuance failures or browser warnings resulting from domain misconfiguration.

7. Intellectual Property

• We retain all rights, title, and interest in the Services, software, trademarks, and documentation.
• You retain all intellectual‑property rights in your website content. You grant us a limited license to host, back up, and display such content solely for the purpose of providing the Services.

8. Termination & Suspension

• You may cancel your account at any time via the dashboard or by emailing support@pmbtexas-enterprises.com.
• We may suspend or terminate the Services immediately, without prior notice, for violation of these Terms or the AUP.
• Upon termination, your data may be deleted after 30 days. We have no obligation to retain data beyond that window.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY SET FORTH HEREIN, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You will defend, indemnify, and hold harmless PMBTEXAS Hosting, its affiliates, and their respective officers, directors, employees, and agents from and against all claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

12. Modifications to the Terms

We may update these Terms from time to time. We will post the revised Terms on our website and update the “Last updated” date. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict‑of‑laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas, and the parties consent to personal jurisdiction therein.
