10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You will defend, indemnify, and hold harmless PMBTEXAS Hosting, its affiliates, and their respective officers, directors, employees, and agents from and against all claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

We may update these Terms from time to time. We will post the revised Terms on our website and update the “Last updated” date. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict‑of‑laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas, and the parties consent to personal jurisdiction therein.
